The Howard County Ambulance District has asked the court for an extension to respond to the City of Fayette’s injunction request.
Attorney Jennifer Griffin filed a motion on July 21 for extra time to file a response to the City of Fayette’s Petition for Injunctive Relief. Griffin was retained by the district on July 20, two days before the response was due on July 22. According to the motion, both sides have agreed to the extension.
Circuit 14 Presiding Judge Scott Hayes granted the motion and scheduled a hearing for August 23.
As was previously reported by the Advertiser, the city is asking a judge for an injunction to prevent the ambulance district from building a new base inside a neighborhood zoned for single-family housing. After the city council denied the district a zoning variance on May 12, the district issued the city a letter the following day stating it is not required to follow zoning laws and would build there anyway.
Since then, the ambulance district’s Board of Directors voted to pause efforts to build on the site, located on the corner of Williams and Cooper streets in Fayette, in order to search for a more suitable site. No site has yet been selected, but an update is expected at the board’s August meeting.
